We do this by channeling our professional training, combined with extensive construction experience, into producing clear and fully detailed construction documents, including all architectural and structural plans necessary to obtain a building permit. Mark and his team have been the primary Engineering firm for my construction company for the past 10 plus years. He engineered over 500 projects for me just last year. 1. Our home is in unincorporated Larimer County, Colorado. We suffered a house fire on October 18, 2015, which destroyed a large portion of our home. We rebuilt in 2016 and 2017. 2. We retained Tri-State Concrete and Excavation under a turnkey contract to perform all excavation, footings, foundations, flatwork, perimeter drain, waterproofing, and backfilling.

The turnkey contract included engineer inspections (in lieu of Larimer County inspections). 3. Tri-State Concrete and Excavation used Mark Benjamin, PE and his company Crown Jade Design and Engineering to perform the required footing and foundation engineering inspections and provide a stamped letter/report to Larimer County. 4. The inspection required by Larimer County is as follows: a. Footing: Concrete forms, placed on undisturbed soil, installed as shown on approved drawings. Reinforcing steel, in place, supported and splices tied. (Concrete cannot be placed before inspection approval) b. Foundation: Concrete forms, placed on undisturbed soil, installed as shown on approved drawings. Reinforcing steel, in place, supported and splices tied. (Concrete cannot be placed before inspection approval) 5.

Mark Benjamin and Crown Jade Design and Engineering provided a PE Stamped "Structural Observation Report". The letter refers to inspection on May 10, 2016 but is dated May 6, 2016. All photographs from Mark Benjamin's entire inspection file are dated May 10, 2016. (Mark Benjamin's file was received under subpoena during the Tri-State lawsuit.) 6. Larimer County and the homeowners relied upon Mark Benjamin's letter and the underlying inspection to meet Larimer County building permit inspection requirements and to assure that the footings and foundation met the structural engineering requirements for safe occupancy. 7.

The concrete foundation was not poured according to the permit plan. Known flaws include reinforcing steel, anchor bolts, and holddowns as shown on approved drawings. 8. In the court trial on December 1, 2017 between the homeowners and Tri-State Concrete, Mark Benjamin testified under oath: that he did "inspect the work performed by Tri-State Concrete, Mr. Whitin"; that the "quality was good on the job"; that Mark Benjamin's position was "making sure the rebar is there"; that he had "looked at all the rebar in the foundation walls and it was there according to plans"; and that "the concrete work done there was in accordance with the standard of the industry". 9.

In the Court Order ruling against the homeowners, the Judge in County Court referred substantially to the representations of Mark Benjamin's testimony "that the work done by the Plaintiff [Tri-State] that was 'good' and 'completed in accordance with industry standards.'" Further, that the "testimony of Mr. Benjamin did not support the assertions of the Defendant [homeowner]." And again, that the homeowner's testimony that the work was not in compliance with the plans was "contrary to the testimony of the structural engineer Mark Benjamin." 10.

To complete construction, the homeowners incurred significant expense for additional engineering and repairs of defective concrete work. Additionally, a result of the Court Order was that the homeowners incurred substantial legal fees and paid Tri-State for services which were not completed and services which were not completed in accordance with the plans.
